General Terms and Conditions of the Easyvoyage pay offer

PREAMBLE

The present general conditions of sale of the easyvoyage offer (hereinafter "the General Conditions of the Offer") are concluded between the company Webedia SA, (hereinafter "Webedia") and the user, as identified at the time of subscription to the Offer (hereinafter "the User").

The present General Terms and Conditions of the Offer determine the conditions and rules of access to the fixed internet site (excluding the mobile application) easyvoyage accessible at the address www.easyvoyage.co.uk - hereinafter "the Site") without advertising cookies.

This fee-based offer allows the User to continue to access our Site without the use of advertising cookies that analyse their browsing data in order to display personalised advertising on our pages ("the Offer"). The User acknowledges and accepts that advertisements will always be visible when he/she accesses the Site. However, these advertisements will not depend on advertising cookies.

What is a "lecookie or paywall"?

This practice consists of offering the user of our website a choice between (i) consenting to the deposit of cookies or (ii) paying a fee to access the site/application. The user will therefore not be able to access the services offered by our website without making this prior choice.

Why have we implemented this "cookie or paywall"?

Our website's business model is essentially based on the display of personalised advertising, which is based on the use of advertising cookies that track users' browsing habits in order to tailor advertising to users' interests. The regulations governing cookies do not allow our company to rely solely on this business model. Consequently, in order to be able to maintain the financing of the Site and provide the services offered while offering you the same quality of editorial content that is constantly renewed, we offer you the possibility of choosing between the following two access alternatives:

  • Continue to access our site free of charge, by accepting the installation of advertising cookies;
  • Subscribing to the paying offer for one month, which will allow you to continue to access our site without advertising cookies being placed on your terminal.

The General Terms and Conditions of the Offer supplement the General Terms and Conditions of Use of the Website. The General Terms and Conditions of Use of the Site form an integral part of these Terms and Conditions and in the event that the General Terms and Conditions of the Offer are silent, the General Terms and Conditions of Use of the Site shall apply.

The User acknowledges that he/she may only subscribe to the Offer if he/she accepts the General Terms and Conditions of the Offer without reservation.

These General Terms and Conditions are only available in French, and this version is the only one that can be invoked. The User may access them at any time at the bottom of each page of the Site and may save and print them.

1. DESCRIPTION OF THE OFFER

This paying offer allows the User who subscribes to continue to access our Website for 30 days from the date of purchase, without advertising cookies being placed on their terminal to analyse their browsing data in order to display personalised advertisements on our pages. The User acknowledges and accepts that advertisements will always be visible when he/she accesses the Site. However, these advertisements will not depend on advertising cookies.

Offer not applicable to the mobile application: This Offer is only valid for the Website and not the mobile application. For any use of the application without advertising cookies, the User must subscribe to another offer directly via the application.

2. ACCESS TO THE OFFER

To subscribe to the Offer and access the Site without advertising cookies, the User must:

  • Accept all the General Terms and Conditions of the Offer
  • Choose their method of payment between using their PayPal account or using their bank card details,
  • Proceed with secure payment for the Offer.

A confirmation e-mail summarising the details of the order will be sent by PayPal to the User. This confirmation e-mail will contain the identification number that the User must enter each time he/she connects to the Site for the first time on a terminal other than the one with which he/she subscribed to the Offer in order to benefit from the Offer.

3. SIGNATURE AND PROOF

3.1 Webedia implements the necessary means to protect Users' personal information by ensuring a high level of security, but the User also has a role in protecting his personal data. In particular, the User must maintain the security of his online transactions, for example by not disclosing his identifiers to anyone and, if necessary, by regularly changing his password. In this respect, Webedia cannot be held responsible for the disclosure of information concerning the User to any individual having used his/her identifiers.

3.2 The provision of the bank card number and the final validation of the subscription to an Offer will constitute proof of acceptance of the said order and will constitute payment of the sums incurred in respect of the order. The computerised registers kept in the computer systems of Webedia and its partners will be considered as proof of communications, orders and payments between the Parties.

The User acknowledges that exchanges between him and Webedi will be mainly electronic (by email) except in the particular cases presented herein or required by law and expressly accepts that invoices will be sent to him by email.

3.3 The identification number or code is personal, secret and non-transferable and the User undertakes not to divulge it. The User must immediately inform Webedia of any loss or unauthorised use of his identification number. Webedia (i) may not be held liable for the use of the identification number by a third party if the third party has gained access to it as a result of a fault and/or negligence on the part of the User and (ii) Webedia shall, where applicable, be entitled to terminate the Offer in accordance with these Conditions.

3.4 Any abuse or attempt to manipulate the system or to use an access code through a third party or group cancels the validity of the access codes, and may result in the closure of the accesses concerned.

Webedia reserves the right, whenever necessary, to take all reasonable measures to protect itself against fraud, including verifying any element concerning a User in order, in particular, to ensure that the User is the customer concerned.

Webedia may not be held liable for any access code that is lost, corrupted or delayed due to any network, computer or software failure whatsoever.

The access code may only be used for personal and non-commercial purposes. Any sharing of the identification code by any means whatsoever is prohibited.

4. NO RIGHT OF WITHDRAWAL

By subscribing to the Offer, the User expressly requests to benefit immediately from the Offer and to access the Site without advertising cookies before the expiry of the withdrawal period. The User acknowledges that by subscribing to the Offer, he/she will not be able to benefit from the fourteen (14) day withdrawal period provided for in article L221-18 of the French Consumer Code.

5. OFFER PRICE

5.1 The price of the Offer is stated on the Site, indicated and payable in Euros inclusive of all taxes, it being understood that the Offers subscribed to are invoiced at the prices in force at the time of their purchase.

Webedia reserves the right to modify the price of the Offer at any time, it being understood that this modification will only apply to new Offers.

5.2 Payment for the Offers is made using the User's Paypal account or a bank payment card. To this end, the User must enter his/her bank card number, the date of validity and the last three digits on the back of the card in the secure Paypal module.

All payments will be processed by Paypal using a secure data encryption procedure so that no information transmitted by the User can be intercepted by third parties. It is up to the User to save and print his payment certificate if he wishes to keep the bank details relating to his transaction.

The User guarantees Webediase that he is fully authorized to use the payment card for the payment of his order and that these means of payment legally give access to sufficient funds to cover the sums due.Webediase may be held responsible for any fraudulent use of the means of payment used.

5.3 Webediase reserves the right to suspend, refuse an order or cancel any subscription, whatever its nature and level of execution, in the event of total or partial non-payment or non-receipt of any sum due by the User, in the event of a payment incident or dispute relating to a payment, or in the event of sharing of access codes, fraud or attempted fraud relating to the use of the Site, including during a previous subscription.

6. DURATION OF THE OFFER

The Offer is concluded for a fixed period of one month (30 consecutive sliding days) from the date of subscription.

The Offer will not be tacitly renewed. If, on expiry of the Offer, the User wishes to continue to be able to access the Site without advertising cookies, he/she simply needs to subscribe to a new one-month Offer under the conditions set out in article 1 above.

7. ADVERTISING

Advertisements will always be visible to Internet users when they access the Site. However, these advertisements will not be based on advertising cookies.

Webedia has complete freedom when it comes to choosing these advertisers, the types of advertisement display and their position on the site.

8. LIABILITY

8.1 Webedia may under no circumstances be required to verify the legal capacity of its Users. Consequently, if a User who does not have legal capacity wishes to subscribe to the Offer on the Site, his/her legal guardians (parents, guardians, in particular) assume full responsibility for this subscription and must, in particular, pay the price.

8.2 The information accessible on the Site is provided "AS IS" without any guarantee of any kind, whether implicit or explicit, concerning in particular the integrity, accuracy, up-to-dateness, non-infringement, availability, reliability or exhaustiveness of the information relating to the services appearing on the Site or its suitability for the use that the User intends to make of it.

8.3 Webedia's liability is limited to direct prejudice to the exclusion of any other prejudice, particularly indirect, of any nature whatsoever. Webedia may not be held liable for any damage suffered by the User or by a third party resulting directly or indirectly from non-compliance by the User with any of his obligations, from negligence, non-compliant use of the Site, in particular for purposes other than those indicated by Webedia, or in the event of delay or failure to fulfil its obligations attributable to the act of a third party, even if foreseeable, or to the occurrence of an event beyond its control, such as a fortuitous event or force majeure as defined by article 1218 of the French Civil Code and the French Courts.

8.4 In any event, within the limits provided by law, in the event that Webedia's liability were to be established and retained due to a loss suffered by the User and attributable exclusively to the subscription of an Offer, the total amount of compensation and of any sum charged to Webedia in this connection is limited to the amount of the sum paid by the User to Webedia on the Site in respect of this Offer. This limitation of liability is not applicable in the event of bodily injury or Webedia's extra-contractual liability.

Any claim against Webedia must be made within 2 months of the occurrence of the event that is the subject of the claim and sent to Webedia by email. Failing this, Webedia will be released from its obligations in this respect.

9. GENERAL PROVISIONS

Assignment - The contracts, rights and obligations of Users may not be assigned or transferred without the prior written consent of Webedia. Webedia's contracts, rights and obligations may be assigned or transferred at any time without the User's prior consent.

Partial invalidity - If one or more stipulations of the General Conditions are held to be invalid or declared as such in application of a law, regulation or following a definitive decision by a competent court, the other stipulations will retain all their force and scope.

Non-waiver - The fact that one of the Parties does not avail itself of a breach by the other Party of any of the obligations referred to in the present General Conditions may not be interpreted for the future as a waiver of the obligation in question.

Termination - Webedia reserves the right to suspend and/or terminate by operation of law, without notice or compensation, the Offer in the event of non-compliance by the User with the General Conditions of the Offerand in particular in the event of multiple simultaneous connections with the same ID number.

Non-compliance by the User with the obligations subscribed to under the terms of the present General Conditions, any incident of payment of the price of an order, actions contrary to the interests of Webedia, the communication of identifiers (access code), false, disparaging or erroneous information, or the use of false or misleading information, denigrating or erroneous information or on a forum or social networks, may result in suspension of access to the Site, or even termination of the Offer depending on the degree of seriousness of the conduct in question, without Webedia being able to claim any damages or compensation whatsoever. Webedia reserves the right to refuse any order from a User with whom there is a dispute of this nature, even if the User uses a new account. Webedia may not then be held liable for any prejudice suffered by the User.

Modifications to the General Conditions

Webediase reserves the right to modify and update the General Conditions without prior notice. A notification will be made on the Site and/or by email to inform the Users of the Site in case of modification of these General Conditions and containing a link to the new version. Any new order for an Offer will be subject to the General Terms and Conditions in force at the date of the order.

Access to the Site - In principle, the Site is accessible to the User 24 hours a day, 7 days a week, except in the event of force majeure, voluntary or involuntary interruption of the Internet network, regardless of the cause, particularly in the event of maintenance. Being subject to an obligation of means, Webedia may not be held liable for any prejudice caused by the unavailability of the Site and/or the non-operation of all or part of the Site.

Intellectual property - All of the elements reproduced on the Site, and in particular but not exclusively the texts, comments, works, illustrations, images, photographs and brands are protected under the intellectual property rights belonging to Webedia or its partners. Any total or partial reproduction of the elements accessible on the Site is strictly forbidden.

10. APPLICABLE LAW. SETTLEMENT OF DISPUTES - MEDIATION

The General Terms and Conditions of the Offer are governed by French law.

In accordance with article L.211-3 of the Consumer Code, in the event of a dispute, the User may have recourse to a mediation procedure for consumers under the conditions provided for in articles L. 611-1 et seq. of the Consumer Code.

If no amicable solution is found, the French courts will have jurisdiction.
